PIRK Terms of Service

Effective date: October 3, 2026

PIRK is currently in beta. Some processes, such as cancellations, refunds and host payouts, are handled by the PIRK team rather than automatically in the app. These Terms describe how the Services work today.

1. Acceptance of these Terms

These Terms of Service (the “Terms”) govern your use of the PIRK website at https://pirkparking.com and related services (together, the “Services”), operated by PIRK (“PIRK,” “we,” “us” or “our”). By creating an account, listing a parking space, making a booking or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for keeping your account credentials secure and for activity that happens under your account, and you agree to provide accurate account information.

2. PIRK is a marketplace

PIRK is an online marketplace that connects drivers looking for parking with independent hosts who offer parking spaces. Hosts are not employees, agents or representatives of PIRK. PIRK does not own, operate, manage, inspect or control the parking spaces listed on the Services, and PIRK is not a party to any arrangement between a host and the owner, landlord, association or manager of a property.

PIRK does not verify host identity, property ownership or the accuracy of listings, and does not guarantee the condition, safety, legality, security or suitability of any space. PIRK is not responsible for vehicles or their contents.

3. Host responsibilities

If you list a parking space on PIRK, you represent and agree that:

  • you have the legal right and any required permission (for example from an owner, landlord, homeowners’ association or property manager) to offer the space for the times you list it;
  • offering the space complies with applicable laws, regulations, leases, permits, HOA rules and other agreements that apply to you or the property;
  • your listing is accurate and kept up to date, including its location, unit or apartment number, parking type, number of spaces, vehicle sizes, amenities, photos, availability, rates and access instructions;
  • the space will be available and accessible as listed for each confirmed booking;
  • you are responsible for any taxes, insurance, licenses or registrations that apply to you as a host; and
  • you will only upload photos and content that you have the right to use.

Hosts set their own hourly and daily rates and availability. PIRK may remove, hide or decline to publish listings at its discretion, including listings that appear inaccurate, unauthorized or in violation of these Terms.

4. Driver responsibilities

If you book a parking space on PIRK, you agree to:

  • use the space only for the dates and times you booked, and leave by the end of your booking;
  • follow the listing’s details and the host’s access instructions;
  • use a vehicle that fits the space and any size limits stated in the listing;
  • obey posted signs, property rules, traffic laws and all other applicable parking rules and laws;
  • not damage the space or the property, block other spaces or access routes, or leave anything behind; and
  • use the space only for parking a vehicle, and not for storage, living, commercial or unlawful activity.

You are responsible for tickets, fines, towing, booting and other costs that result from your use of a space or from not following these responsibilities.

5. Bookings and payment

  • Prices. The price of a booking is calculated by PIRK from the host’s listed rates for the dates and times you select. The total, including any PIRK service fee, is shown before you pay. Prices are in U.S. dollars.
  • Payment. Payments are processed by our third-party payment processor, Stripe. You enter your payment details with Stripe at checkout each time you book. PIRK does not store full payment-card numbers. Your use of Stripe is also subject to Stripe’s terms and privacy policy.
  • Holds. When you start checkout, the space is held for you for a limited time. If payment is not completed before the hold expires, the hold is released and the space may be booked by someone else.
  • Confirmation. A booking is confirmed only after your payment has been successfully received. Once confirmed, you can see the space’s exact address and access instructions in My Bookings. Before a booking is confirmed, only the listing’s approximate location is shown.
  • Unavailable spaces. If a payment is received but the space can no longer be booked (for example, because the times are no longer available), PIRK will not confirm the booking and will refund the payment.

6. PIRK service fees

PIRK may charge drivers a service fee on bookings. Any service fee is shown as a separate line before you pay and is included in your total. PIRK may introduce or change service fees in the future; any change applies only to bookings made after the change, and the applicable fee will always be shown before you pay. Except as described in Section 7, service fees are not refundable.

7. Cancellations, changes and refunds

During the current beta, cancellations, changes and refunds are not available directly in the app. To request a cancellation, change or refund, contact PIRK Support at support@pirkparking.com with your booking details as soon as possible, and preferably before your booking starts.

  • PIRK reviews each request based on the circumstances of the booking, such as how far in advance you contact us, whether the booking has started, and whether the space was available and as described.
  • Submitting a request does not guarantee a refund. Refunds, including whether a refund is full or partial and whether the service fee is included, are at PIRK’s discretion, except where applicable law requires otherwise.
  • If PIRK cancels a booking, or a host cannot provide the space as booked, PIRK will review the situation and may issue a full or partial refund.
  • Approved refunds are returned to the original payment method through Stripe. The time for a refund to appear depends on your bank or card issuer.

8. Host payouts

To receive payouts, a host must connect a payout account through Stripe, our payment processor, and complete Stripe’s verification and onboarding. Stripe is responsible for collecting and verifying payout account and identity information, and your use of Stripe is subject to Stripe’s terms, including the Stripe Connected Account Agreement. PIRK does not store your bank account details.

  • For each completed booking, the host’s payout is the booking price based on the host’s rates, not including any PIRK service fee.
  • During the current beta, host payouts are not automatic and may be reviewed and released manually by PIRK after a booking is completed. PIRK does not guarantee a specific payout date.
  • Once PIRK releases a payout, the timing of the transfer to your bank account is determined by Stripe and your bank.
  • PIRK may delay or withhold a payout while a booking is under review, and if a booking is refunded or disputed, PIRK may withhold the related payout or reverse it where permitted.
  • Hosts are responsible for any taxes on their earnings.

9. Prohibited conduct

You agree not to:

  • list a space you do not have the right to offer, or create false, misleading or duplicate listings or accounts;
  • use another person’s account or payment method without permission, or commit or attempt fraud;
  • arrange or take payment for a booking found on PIRK outside of the Services;
  • harass, threaten, discriminate against or endanger other users;
  • use the Services for any unlawful purpose or in violation of these Terms;
  • upload content that is unlawful, infringing, misleading or harmful, or that contains malware;
  • scrape, copy or harvest data from the Services, or access them by automated means without our permission; or
  • interfere with, disrupt, probe or try to gain unauthorized access to the Services, other accounts or our systems.

10. Disputes and chargebacks

If you have a problem with a booking, a space or another user, contact PIRK Support first at support@pirkparking.com. PIRK may help review the issue, but disputes between hosts and drivers are primarily between them, and PIRK is not required to resolve them.

If you believe a charge is incorrect, please contact us before disputing it with your bank or card issuer, so we can try to resolve it quickly. If a driver files a chargeback or payment dispute, PIRK may share relevant booking information with Stripe and the card issuer, may withhold or reverse the related host payout, and may suspend the accounts involved while the dispute is open. Chargebacks found to be unjustified may lead to account suspension or termination.

11. Disclaimers

The Services are provided “as is” and “as available,” and, during the beta, may change, contain errors or be temporarily unavailable. To the fullest extent permitted by law, PIRK disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and makes no warranty about any listing, space, host or driver.

12. Limitation of liability

To the fullest extent permitted by law, PIRK and its owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, or for damage to or theft of any vehicle or property, personal injury, tickets, fines or towing arising out of or relating to the Services, any space or any interaction between users, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the limitations above may not apply to you, and in those cases PIRK’s liability is limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify and hold PIRK harmless from third-party claims, and related losses, damages and reasonable legal fees, to the extent they arise from (a) your violation of these Terms, (b) your misuse of the Services, or (c) your violation of another person’s rights.

13. Account suspension and termination

You may stop using the Services at any time, and you can request deletion of your account as described on our data deletion page. PIRK may suspend, restrict or terminate your account, remove listings or cancel bookings, with or without notice, if we reasonably believe you have violated these Terms, created risk or possible legal exposure for PIRK or others, or engaged in fraud or abuse, or if required by law. Where a booking is cancelled for these reasons, PIRK will decide whether a refund is appropriate. Sections that by their nature should survive termination, including Sections 7, 8, 10, 11 and 12, will survive.

14. Changes to these Terms

We may update these Terms from time to time, for example as the Services move out of beta. When we do, we will update the effective date above and, where appropriate, provide additional notice. Changes apply from the effective date and do not affect bookings confirmed before that date. Your continued use of the Services after an update means you accept the revised Terms.
